These Terms of Service ("Terms") govern your use of the Lendo.My platform at lendo.my (the "Platform"), operated by Lendo.My ("Lendo", "we", "us"). By using the Platform you agree to these Terms. If you do not agree, do not use the Platform.

1. What Lendo is

Lendo is an online marketplace that connects users who wish to rent out items or services ("Owners") with users who wish to rent them ("Renters"). Lendo is a venue and facilitator only. We are not the owner, manufacturer, seller or operator of any listed item, and the rental contract for any booking is between the Owner and the Renter.

2. Eligibility and accounts

• You must be at least 18 years old and able to enter into a binding contract.
• You are responsible for the accuracy of your account information and for keeping your login credentials secure.
• You are responsible for all activity that occurs under your account.
• We may require identity verification, and may limit features until verification is complete.

3. Listings (Owners)

• You must have the legal right to rent out any item you list, and the item must be safe, accurately described and lawful.
• You set the rental price, deposit and any delivery terms. You are responsible for the condition and handover of the item.
• Prohibited items include anything illegal, stolen, counterfeit, unsafe, or that you are not authorised to rent.

4. Bookings (Renters)

• When you book, you agree to use the item lawfully and in line with the Owner's reasonable instructions, and to return it on time in the condition you received it (fair wear and tear excepted).
• You are responsible for loss of or damage to the item during your rental, which may be deducted from your deposit or otherwise recovered.

5. Payments, fees and deposits

• Payments are processed by our payment providers (Stripe and Billplz). By making a booking you authorise the applicable charges.
• Lendo charges a platform service fee, which is reflected in the amounts shown at checkout.
• For applicable bookings, the Renter pays a refundable security deposit. Lendo may hold the booking amount and deposit until the rental is completed, then release the Owner's earnings and return the deposit, subject to any valid claims.
• Owner payouts are made to the Owner's connected payout account or via the payout method we make available.

6. Cancellations and refunds

Cancellation and refund outcomes depend on the status of the booking at the time of cancellation. Where a booking is cancelled before completion in accordance with the Platform's process, eligible amounts are refunded to the original payment method. Refund timing depends on the payment method and provider.

7. Disputes and deposits

If a dispute arises over an item's condition, return or a deposit, either party may raise it through the Platform before the booking is finalised. Lendo may, at its discretion, review the information provided and decide how a deposit is allocated between the parties. Lendo's role in disputes is limited to administering deposits and is not a substitute for legal remedies available to you.

8. Acceptable use

You agree not to misuse the Platform, including by: posting false or misleading information; attempting to transact off-Platform to avoid fees; harassing other users; infringing others' rights; or interfering with the security or operation of the Platform.

9. Disclaimers

The Platform is provided "as is" without warranties of any kind, to the extent permitted by law. Lendo does not warrant the quality, safety, legality or availability of any listed item, or the conduct of any user. You deal with other users at your own risk.

10. Limitation of liability

To the maximum extent permitted by Malaysian law, Lendo is not liable for any indirect, incidental, special or consequential loss, or for loss of profits, arising from your use of the Platform or any rental. Nothing in these Terms excludes liability that cannot be excluded by law.

11. Indemnity

You agree to indemnify and hold Lendo harmless from claims, losses and expenses arising out of your listings, bookings, use of the Platform, or breach of these Terms.

12. Suspension and termination

We may suspend or terminate your access if you breach these Terms or to protect the Platform and its users. You may stop using the Platform and request account deletion at any time via our Data Deletion page.

13. Governing law

These Terms are governed by the laws of Malaysia, and you submit to the jurisdiction of the courts of Sabah, Malaysia.

14. Changes

We may update these Terms from time to time. The updated version takes effect when posted here. Your continued use of the Platform after changes means you accept them.
